Acceptance of Terms: By purchasing any product from Benjineering "Ben Hodge" New Zealand, whether through our online store, social media platforms, or any other channels, or in person or in any physical stores, or anywhere at all, by purchasing anything you agree to be bound by these terms of service even if you didn't ask to read them or haven't red them.

for the fireplaces and such that we sell, they are un tested appliances and are made for outdoors & places that don’t require permits, they are unofficially tested as best as can be, by me & some of my customers, and are safe to use under proper operation & supervision, but for legal reasons they were originally made for outdoor use so putting them indoors is completely up to you and at your own risk.

Product Liability: Benjineering "Ben Hodge" New Zealand shall not be held liable for any injuries, damages, or losses resulting from the use or misuse of our products. Customers assume all risks associated with the use of our products.

Exclusion of Liability: Benjineering "Ben Hodge"  New Zealand expressly disclaims any liability for damages or losses, whether direct, indirect, incidental, consequential, or punitive, arising out of or related to the use of our products.

Negligence and Misuse: Benjineering "Ben Hodge"  New Zealand shall not be responsible for any injuries, damages, or losses resulting from negligence, misuse, or improper handling of our products.

Assumption of Risk: Customers acknowledge and accept that the use of our products involves inherent risks, and they agree to assume all such risks.

Indemnification: Customers agree to indemnify and hold Benjineering "Ben Hodge" New Zealand harmless from any claims, damages, losses, or liabilities arising out of or related to the use of our products.

Modification of Terms: Benjineering "Ben Hodge" New Zealand reserves the right to modify or update these terms of service at any time without prior notice. Any changes will be effective immediately upon posting on our website or other platforms.

Governing Law: These terms of service shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

Severability: If any provision of these terms of service is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

and laws, its because we haven't put them through all the checks and had them complied to avoid additional costs to save on the costs of the fires, although they may be ok to be signed off for use in your full sized fixed down house but you would need to check with you local council on the rules as every councils rules are different if that's the road you want to go down.

Any deposits paid for on all orders are non refundable if you back out of the purchase for any reason in most cases, this is because we make the products to order and its costs us time and money/materials etc. But in some cases if we haven't began to process and make your order and you decide you want a refund we may provide one as we wouldn't be losing out on any time or materials, contact us asap if this is the case.

By purchasing products from Benjineering "Ben Hodge" New Zealand, you acknowledge that you have read, understood, and agreed to these terms of service. If you do not agree with any part of these terms, you should not purchase or use our products.

The equipment provided by Benjineering "Ben Hodge" including wood-fired boilers, hot water systems, and related products, has been carefully designed and built using quality materials, safety precautions, and tested engineering methods to ensure safe use when operated as intended. However, these units are not formally certified pressure vessels or appliances. 

By hiring, purchasing, or using any product from Benjineering "Ben Hodge", whether in person, through our website, TradeMe, Facebook, or any other platform or sales channel, the customer automatically agrees to the following terms and conditions, whether or not they have been read in full. These terms are made available at all times and at the time of hire or sale and can be accessed via our website or upon request at any time.

By accepting the product, the customer acknowledges and agrees that:

They understand the nature and use of the equipment, including the presence of combustion elements, pressurized hot water, and heat.

They assume full responsibility for the setup, safe operation, ongoing maintenance, and supervision of the equipment.

They accept all risks associated with use, including but not limited to potential injury, harm, or equipment failure.

Modification of Terms: We reserve the right to modify or update our return policy at any time without prior notice. By making a purchase from our store, you agree to abide by the terms and conditions outlined in this return policy.
